Membership Terms and Conditions.

PLEASE READ THE TERMS AND CONDITIONS OF THIS CONTRACT

By completing payment you are confirming that you have read, understood, and are agreeing to the terms & conditions and cancellation policies outlined below.
Between: You (The Member) and HENCH (The Gym).

1.0 GENERAL

1.1 All contracts must be paid for in advance. Memberships will not be confirmed until payment has been received.
1.2 I understand there are inherent risks in participating in a program of strenuous exercise. If I sustain or claim to sustain any injury while participating in the program, I acknowledge that The Gym and the coaching team are not responsible - except where the injury was caused by gross negligence or by an intentional act of the coach.
1.3 I will adhere to all instructions given to me by The Gym staff.
1.4 I understand my progress is dependent upon my effort, cooperation, consistency, and adherence to the program both inside and outside of the training sessions themselves.
1.5 I understand that opening times are subject to change and will vary from the regular schedule over holiday and Bank Holiday periods.
THE MONEY BACK GUARANTEE
1.6 I understand that in order to be eligible for the money-back promise, I must attend at least 3 coached sessions per week at The Gym (every week), track training via Train Heroic, and hit my nutrition targets (if set by The Gym) every day and complete InBody measurements with the Gym's coaches, every month for the full duration of my membership.

2.0 CONTRACT DURATION & RENEWAL

2.1 I understand that by completing payment and agreeing to this contract, I commit myself to a minimum contracted term of 3 months, or 12 months (depending on the selected option).
2.2 I understand that this contract is in force for a rolling calendar of 3 months or 12 months (as appropriate) from the contract start date - this commences when payment is successfully processed.
2.3 I understand that once I go past the minimum term set out in my contract, I will automatically enter a rolling monthly contract, where a 60-day notice period is required for cancellation.

3.0 PAYMENTS

3.1 The Member agrees to pay monthly recurring fees (as appropriate for the selected membership) for every month’s membership at The Gym via recurring card payment through the Stripe payment system.
Note: This contracted membership allows attendance to your allotted group coaching sessions per week at The Gym, unused sessions DO NOT carry over from week to week or billing period to billing period.
3.2 I agree to purchase a recurring membership at The Gym as an automatic charge to my credit/debit card every month for a minimum contracted period of 3 months or 12 months (as appropriate), which then automatically enters into a rolling monthly contract unless requested to be cancelled by either myself with 60 days notice.
3.3 I hereby certify that I am the holder of the credit/debit card detailed when signing up to this contract via Stripe.
3.4 I understand that my service will be deactivated if my account becomes more than 60 calendar days late.

4.0 MEMBERSHIP PAUSES

4.1 Membership Pauses are possible during the contracted period of 3 or 12 months (as appropriate).
4.2 Membership Pauses are limited to 60 days (2 payments) per calendar year, in 30-60 day increments only.
4.3 All Membership Pause requests require 60 days notice before the next scheduled payment date - any requests received later cannot be processed until after the next scheduled payment.
4.4 Any unused coaching session credits during a Membership Pause will be carried over to the next month, but must be used within 30 days after the pause ends. Unused credits will expire after this 30-day period.
4.5 Membership Pauses must be communicated in writing to The Gym's management and can only be actioned with their approval.

4.6 During a Membership Pause, the Member's access to coaching sessions, open gym sessions, and other gym facilities will be suspended.
4.7 The Membership Pause period will extend the minimum contracted term by the same number of days as the pause.

5.0 MEMBERSHIP CHANGES - UPGRADES AND DOWNGRADES

5.1 Members can request to upgrade or downgrade their membership plan once every three months.

5.2 All membership change requests must be submitted in writing to The Gym's management at least 14 days before the desired change date.

5.3 Upgrades or downgrades will take effect on the first day of the next billing cycle after the change request has been approved by The Gym's management.

5.4 In the case of an upgrade, the member's new monthly fee will be charged starting from the next billing cycle, and additional coaching session credits will be made available immediately.

5.5 In the case of a downgrade, the member's new monthly fee will be charged starting from the next billing cycle, and the reduced number of coaching session credits will apply from that billing cycle onwards.

5.6 Any unused coaching session credits from the previous membership plan will not be carried over to the new membership plan.

6.0 CANCELLATIONS

6.1 Cancellation within the contracted period of 3, 6 or 12 months (as appropriate and excluding prepaid memberships) is only permitted under the following circumstances: a) The Member suffers a serious injury or illness that prevents them from participating in the gym activities for the remainder of the contracted period. In this case, a doctor's note confirming the member's inability to participate must be provided. b) The Member moves more than 15 miles away from The Gym, making it unreasonably difficult to continue attending sessions. In this case, proof of relocation must be provided.
6.2 If the Member wishes to cancel their membership after the minimum contracted term has expired, they must provide a 60-day notice in writing to The Gym's management.
6.3 Upon cancellation, all future payments will be stopped, and the Member's access to coaching sessions, open gym sessions, and other gym facilities will be terminated.

7.0 AGREEMENT

7.1 The Member agrees to all the terms and conditions outlined in this contract. 7.2 The Member understands that this contract is legally binding and commits to fulfilling their obligations as outlined in this document.
